RESOLUTION INTRODUCED BY THE EXECUTIVE COMMITTEE OPPOSING THE ADOPTION OF NEW YORK SENATE BILL S.7791 AND ASSEMBLY BILL A.8386 WHICH WOULD ENACT THE FAITH-BASED AFFORDABLE HOUSING ACT
WHEREAS, the New York State Senate and the New York Assembly are currently discussing similar Bills which would enact the Faith-Based Affordable Housing Act; and
WHEREAS, Senate Bill S.7791 and Assembly Bill A.8386 if adopted and executed by the Governor would add a new Section 96-c to the General Municipal Law which is being referred to as the Faith-Based Affordable Housing Act; and
WHEREAS, the Faith-Based Affordable Housing Act would limit local municipal review of residential development on religious land by permitting said projects to be constructed without site plan review, without compliance with local zoning, building and planning laws and regulations and would limit the local building department's review of a building permit application to a ministerial act ; and
WHEREAS, the Faith-Based Affordable Housing Act would permit density of thirty (30) residential units per acre built on religious land; and
WHEREAS, the Faith-Based Affordable Housing Act would eliminate the necessity of the standard environmental review of residential development on religious land ; and
WHEREAS, the Sullivan County Legislature does not believe that the adoption and enactment of the Faith-Based Affordable Housing Act is in the best interest of the municipalities and the citizens of Sullivan County.
