Title: WHEREAS, property located in the Town of Thompson designated on the Sullivan County Real Property Tax Map as 51.-1-29.1 being +/-17.20 acres and located at Katrina Falls Road is owned by the County of Sullivan by virtue of an Article 11 foreclosure for 2019 taxes; and WHEREAS, Daryl A. and Jeri Lynn Mitchell own an 8.12 acre parcel of land known as Town of Thompson tax map #51.-1-31.4 which is adjacent to the parcel noted above. The parcel owned by Mitchell is land-locked. As such, Daryl A. and Jeri Lynn Mitchell have offered to purchase said property from the County of Sullivan for the sum of Fifty Thousand Three Hundred Twenty Three ($50,323.00) Dollars (full market price pursuant to the County's auctioneers) plus auction/recording fees to provide access to the land-locked parcel. WHEREAS, property located in the Town of Thompson designated on the Sullivan County Real Property Tax Map as 51.-1-29.1 being +/-17.20 acres and located at Katrina Falls Road is owned by the County of Sullivan by virtue of an Article 11 foreclosure for 2019 taxes; and

WHEREAS, Daryl A. and Jeri Lynn Mitchell own an 8.12 acre parcel of land known as Town of Thompson tax map #51.-1-31.4 which is adjacent to the parcel noted above. The parcel owned by Mitchell is land-locked. As such, Daryl A. and Jeri Lynn Mitchell have offered to purchase said property from the County of Sullivan for the sum of Fifty Thousand Three Hundred Twenty Three ($50,323.00) Dollars (full market price pursuant to the County's auctioneers) plus auction/recording fees to provide access to the land-locked parcel. Daryl A. and Jeri Lynn Mitchell have also agreed to combine the two lots in question (51.-1-29.1 and 51.-1-31.4); and

WHEREAS, the Real Property Advisory Board has reviewed the offer of the Daryl A. and Jeri Lynn Mitchell and recommends that the County accept their offer as it provides access to a landlocked property as defined in Chapter ?164-8(C) of the Sullivan County Code, with the condition that the two lots be combined as soon as possible; and

WHEREAS, in addition to the purchase price of $50,323.00, the Purchasers will also be responsible for the 10% auctioneer fee, recording fees and any other applicable charges, including but not limited to, omitted and pro-rated taxes, water and sewer charges, if any.

NOW, THEREFORE, BE IT RESOLVED, the Chairman of the Sullivan County Legislature is hereby authorized to execute the necessary documents in order to convey the aforesaid premises to Daryl A. and Jeri Lynn Mitchell upon payment of $55,912.30 to the County Treasurer together representing the purchase price, auctioneer fee and recording fees.
