RESOLUTION INTRODUCED BY THE PLANNING, REAL PROPERTY AND ECONOMIC DEVELOPMENT COMMITTEE TO AUTHORIZE A MODIFICATION OF A CONTRACT WITH DELTA ENGINEERS, ARCHITECTS & LAND SURVEYORS, DPC, SUCCESSOR IN INTEREST TO HAAS LANDSCAPE ARCHITECTS, TO PROVIDE ADDITIONAL CONSTRUCTION SUPPORT SERVICES FOR THE NYS DEC FISHING ACCESS LOCATED IN THE TOWN OF HIGHLAND, NY

Specify Compliance with Procurement Procedures:
WHEREAS, a Request for Proposals (R-16-13)was issued in 2016 soliciting professional services for the preparation of engineering and construction documents addressing planned improvements at the Upper Delaware River public access site located in the Town of Highland; and
WHEREAS, by a contract dated 12/1/16 Haas Landscape Architects undertook the engineering and construction documents to an agreed upon ninety percent (90%) of completion; and
WHEREAS, Haas Landscape Architects has been incorporated into Delta Engineers, Architects, & Land Surveyors, DPC (Delta); and
WHEREAS, through resolution no 157-20 adopted on March 16, 2020 and a contract dated October 29th, 2020, Delta was authorized to complete the engineering to 100% bid ready documents; and
WHEREAS, through resolution no 141-21 Delta was authorized to provide construction support services including oversight of the bid process; and
WHEREAS, cost increases required repeated revisions to the project designs and bid documents in order to scale the project to the available funding, resulting in four iterations of the bid before the successful award of a construction contract; and
WHEREAS, such additional services were beyond the initial contract scope and Delta has requested a modification to account for the increased work provided; and
WHEREAS, the cost of Delta’s services is included in the total project budget, and the increase has been accounted for in the adjustments made to the budget in conjunction with the final bid package; and
WHEREAS, the proposed contract modification will therefore not require an increase in the funding commitment to the project from Sullivan County;
NOW, THEREFORE BE IT RESOLVED, the Sullivan County Legislature hereby authorizes a modification of the contract dated 4/1/21 with Delta Engineers, Architects & Land Surveyors, DPC, to provide construction support services not to exceed $12,370 in a form approved by the County Attorney.
