RESOLUTION INTRODUCED BY THE EXECUTIVE COMMITTEE SUPPORTING THE EXTENSION OF THE REDEMPTION DATE FOR THE ARTICLE 11 FORECLOSURE PROCEEDING FOR THE 2019 AND 2020 LIEN YEARS
WHEREAS, the redemption date set for the Real Property Tax Law Article 11 foreclosure proceeding ("Article 11") for the 2019 and 2020 tax lien years has been extended pursuant to Court Order in both proceedings, and
WHEREAS, Sullivan County Treasurer Nancy Buck acting as the County's Article 11 Enforcing Officer sought those extensions based upon legislation and Executive Orders staying the proceedings as well as the creation of the Homeowners Assistance Fund ("HAF") which provided homeowners with funding to pay off real property tax arrears, and
WHEREAS, Treasurer Buck has been informed that some Sullivan County homeowners whose homes are currently subject to foreclosure have been approved for HAF funding but the monies were not made available prior to the expiration of the current redemption date of April 30, 2022, and
WHEREAS, the 2019 and 2020 lien years were due and owing during the height of the COVID-19 pandemic and the Sullivan County Government Center was not always open to the public during that time so payments in person were not possible, and
WHEREAS, Treasurer Buck believes that in the interest of fairness the redemption date should be extended from April 30, 2022 until June 30, 2022 to allow homeowners currently eligible for HAF funding to redeem their homes and to allow all owners of real property one last opportunity to redeem their parcels d...
