RESOLUTION INTRODUCED BY executive committee TO Enter into a stipulation of settlement agreement for the benefit of the sullivan county adult care center
WHEREAS, Jacalyn A Kearns, as Power of Attorney for Melvin Cooperberg, entered into an agreement dated October 27, 2021 with the Sullivan County Adult Care Center (ACC) on behalf of Melvin Cooperberg; and
WHEREAS, Mr. Cooperberg was a Medicare recipient and Ms. Kearns, as Power of Attorney for Mr. Cooperberg, had control of Cooperberg’s limited assets, and agreed to be responsible for payment to the ACC; and
WHEREAS, Mr. Cooperberg passed away on or about March 25, 2023 with debt owed to the ACC in the amount of Twelve Thousand Two Hundred Fifty-Four Dollars and Eighty-Seven Cents ($12,254.87); and
WHEREAS, Infinite Care, on behalf of the ACC hired the Law Firm of Abrams Fensterman, LLP to collect said debt; and
WHEREAS, it was determined by Abrams Fensterman LLP that Mr. Cooperberg had limited assets at the time of his death, insufficient to pay the entire debt; and
WHEREAS, Abrams Fensterman LLP has negotiated a settlement with Ms. Kearns on behalf of Mr. Cooperberg in the amount of Five Thousand Nine Hundred Eighty-Five Dollars and Ninety-Two Cents ($5,985.92); and
NOW, THEREFORE, BE IT RESOLVED, that the County Manager is hereby authorized to sign the Stipulation of Settlement Agreement, and any other documents necessary to effectuate this settlement on behalf of the County of Sullivan; and said Agreement shall be in such form as shall be approved by the County Attorney.
