RESOLUTION INTRODUCED BY THE EXECUTIVE COMMITTEE TO DENY A REQUEST TO CORRECT THE 2026 TAX ROLL OF THE TOWN OF MAMAKATING FOR TAX MAP #4.-1-21
WHEREAS, an application dated March 3, 2026 having been filed by Robert & Tamara Carroll with respect to property assessed to said applicant on the 2026 tax roll of the Town of Mamakating bearing Tax Map #4.-1-21 pursuant to Section 554 of the Real Property Tax Law, requesting a correction to the assessment of the aforementioned parcel due to incorrect building inventory; and
WHEREAS, the Director of Real Property Tax Services has duly investigated the application and filed his report dated March 12, 2026 recommending this Board deny said application; and
WHEREAS, this Board has duly examined the application and report and does find as follows:
(a) That the application be denied because the reason for the correction of error (COE) does not meet the requirements for a COE. An incorrect description of a building(s) is not a correctable error pursuant to Real Property Tax Law Sections 550 & 554. This claim is a grievance of valuation that must be brought before the Board of Assessment Review on grievance day.
NOW, THEREFORE, BE IT RESOLVED, that the application be denied upon the grounds herein set forth; and
