RESOLUTION INTRODUCED BY PUBLIC WORKS COMMITTEE TO ENGAGE AN INVESTIGATOR TO INVESTIGATE VIOLATIONS OF THE COUNTY'S FLOW CONTROL ORDINANCE
WHEREAS, Section 171-6(B) of the County Code, commonly referred to as the "Flow Control Ordinance," prohibits the pick up or hauling of solid waste and/or recyclables generated inside the County to a solid waste management facility located outside of the County;
WHEREAS, violations of the Flow Control Ordinance are punishable by civil, criminal and administrative penalties;
WHEREAS, the County Legislature has determined that enforcement of the Flow Control Ordinance is necessary to protect public health and safety;
WHEREAS, the County Legislature has determined that enforcement of the Flow Control Ordinance requires evidence gathering to support a determination that a violation has occurred and that penalties should be imposed;
WHEREAS, the County Legislature has determined that the engagement of an investigator is reasonable and necessary to support enforcement of the Flow Control Ordinance; and
WHEREAS, the County Legislature has determined that such investigator will be compensated by the County on an hourly basis at the rate of $44.90 per hour and not to exceed $10,000.
