Title: WHEREAS, pursuant to an Inter-Municipal Agreement the County of Sullivan ("County"), the County Treasurer's Office commenced and concluded a Real Property Tax Law Article 11 foreclosure proceeding on behalf of the Village of Liberty ("Village"); and WHEREAS, one of the parcels of real property foreclosed upon is a 0.03 acre lot of vacant land located at School Street and is designated on the Town of Liberty tax map as Section 108 Block 6 Lot 39 ("Subject Parcel"), and WHEREAS, the Village has maintained title and ownership of the Subject Parcel since August 27, 2012 and has designated the parcel for public use, and WHEREAS, the Village has recently learned that this parcel has not been deemed exempt from taxation and as such, there are twelve years of unpaid County real property taxes which still remain unpaid and are a lien against the Subject Parcel, and WHEREAS, the Village has requested that the County accept the "County Amount" of said delinquent taxes and waive the paymen...

Narrative of Resolution:

WHEREAS, pursuant to an Inter-Municipal Agreement the County of Sullivan (“County”), the County Treasurer’s Office commenced and concluded a Real Property Tax Law Article 11 foreclosure proceeding on behalf of the Village of Liberty (“Village”); and

 

                     WHEREAS, one of the parcels of real property foreclosed upon is a 0.03 acre lot of vacant land located at School Street and is designated on the Town of Liberty tax map as Section 108 Block 6 Lot 39 (“Subject Parcel”), and

 

                     WHEREAS, the Village has maintained title and ownership of the Subject Parcel since August 27, 2012 and has designated the parcel for public use, and

 

                     WHEREAS, the Village has recently learned that this parcel has not been deemed exempt from taxation and as such, there are twelve years of unpaid County real property taxes which still remain unpaid and are a lien against the Subject Parcel, and

 

                     WHEREAS, the Village has requested that the County accept the “County Amount” of said delinquent taxes and waive the payment of the accrued penalties and interest and release its lien against the Subject Parcel, and

 

                     WHEREAS, the Real Property Advisory Board has reviewed the request of the Village and recommends that the County accept its offer as it resolves twelve years of open taxes.

 

                     NOW, THEREFORE, BE IT RESOLVED that the Sullivan County Legislature hereby authorizes the Sullivan County Treasurer to waive the penalties and interest accrued against the Subject Parcel, to accept payment of the County Amount of the tax arrears as payment in full and to release the County’s lien against the Subject Parcel.
