Title: RESOLUTION INTRODUCED BY EXECUTIVE COMMITTEE TO SELL PROPERTY ACQUIRED BY THE COUNTY OF SULLIVAN BY VIRTUE OF THE IN REM TAX FORECLOSURE PROCEEDING FOR THE 2023 LIEN YEAR IN THE TOWN OF MAMAKATING KNOWN AS MA16.-1-7.5

WHEREAS, property located in the Town of Mamakating, designated on the Sullivan County Real Property Tax Map as 16.-1-7.5, consisting of approximately 3.75 acres and located on Ferguson Road (the “Premises”), is owned by the County of Sullivan by virtue of an Article 11 tax foreclosure for unpaid 2023 taxes; and

 

WHEREAS, the Premises consist of vacant land with no reasonable means of access; and

 

WHEREAS, the Premises were offered for sale at public auction in 2025, but the successful bidder forfeited the bid after determining that the Premises had no reasonable means of access; and

 

WHEREAS, following the 2025 auction, the Real Property Advisory Board reviewed the Premises and determined that the best course of action was to offer the Premises for private sale to the adjoining property owners for fair market value, thereby providing an opportunity for an adjoining owner to acquire the Premises and establish reasonable access through a combination, easement, or other lawful means; and

 

WHEREAS, the Sullivan County Attorney’s Office notified the three adjoining property owners-New York-New Jersey Trail Conference, New York State Department of Environmental Conservation, and Tuxedo Sportsmen’s Association, Inc.-of the opportunity to purchase the Premises pursuant to the County’s Local Law; and

 

WHEREAS, the New York-New Jersey Trail Conference was the only adjoining property owner to submit an offer and provided an appraisal supporting its offer to purchase the Premises for NINE THOUSAND SEVEN HUNDRED FIFTY DOLLARS ($9,750.00); and

 

WHEREAS, the sale of the Premises to the New York-New Jersey Trail Conference for the appraised fair market value is in the best interest of the County, will provide a reasonable disposition of otherwise inaccessible County-owned property, and will avoid another unsuccessful public auction sale; and

 

NOW, THEREFORE, BE IT RESOLVED, that the Chairman of the Sullivan County Legislature is hereby authorized to execute all necessary documents to convey the Premises to the New York-New Jersey Trail Conference for the purchase price of $9,750.00, upon payment of said amount to the Sullivan County Treasurer together with recording fees.
