Authorize execution of a perpetual easement required for the installation and maintenance of public broadband infrastructure as part of the County’s Municipal Infrastructure Program (MIP). The easement will facilitate construction of telecommunication facilities necessary to expand broadband service in the Town of Rockland.

RESOLUTION INTRODUCED BY BRIAN MCPHILLIPS , CHAIR OF THE MANAGEMENT AND BUDGET COMMITTEE TO AUTHORIZE THE COUNTY MANAGER TO EXECUTE A PERPETUAL EASEMENT AGREEMENT FOR THE INSTALLATION, OPERATION, AND MAINTENANCE OF PUBLIC BROADBAND INFRASTRUCTURE
WHEREAS, the County of Sullivan is implementing its Municipal Infrastructure Program (MIP) broadband expansion project to provide high-speed broadband service throughout Sullivan County; and
WHEREAS, the County has determined that it is necessary to obtain a perpetual easement across property located at 4 Maple Street, Roscoe, New York (Tax Map No. 34.-5-4), for the installation, operation, maintenance, repair, replacement, and access to telecommunications infrastructure consisting of one utility pole, underground conduit, and a four-foot-wide utility corridor; and
WHEREAS, the property owner has agreed to grant such easement upon terms and conditions that shall be set forth in an Easement Agreement to be in a form approved by the County Attorney.
NOW, THEREFORE, BE IT RESOLVED, that the Sullivan County Legislature hereby authorizes the County Manager to execute any necessary easement documents, together with such non-material modifications as may be approved by the County Attorney, and to execute any additional documents necessary to effectuate the purposes of this Resolution; and
BE IT FURTHER RESOLVED, that the Clerk of the Legislature is hereby directed to provide certified copies of this Resolution to the County Manager, County Attorney, Division of Information Technology Services, Division of Grants Administration, Real Property Tax Services and all other parties as deemed necessary.
