RESOLUTION INTRODUCED BY * TO SELL PROPERTY ACQUIRED BY THE COUNTY OF SULLIVAN BY VIRTUE OF THE IN REM TAX FORECLOSURE PROCEEDING FOR THE 2024 LIEN YEAR IN THE TOWN OF BETHEL KNOWN AS BE5.-1-24 & BE5.-5-16

WHEREAS, property located in the Town of Bethel designated on the Sullivan County Real Property Tax Map as Bethel 5.-1-24 & 5.-5-16, being a total of 47.00 +/-acres, located on Briscoe Rd & Lakeside Ave., are owned by the County of Sullivan by virtue of an Article 11 foreclosure for 2024 taxes; and

WHEREAS, the two parcels in question are the roads and bottom of the lake within the Briscoe Lake subdivision; and

WHEREAS, at the specific request and insistence of the County Treasurer, Hartwood Appraisal provided a written statement that the subject parcels have no value as they consist of roads and underwater lands, a copy of which is attached; and

WHEREAS, the Briscoe Lake Community Association has offered to purchase the parcel for ($1,300.00) Thirteen Hundred Dollars which covers all of the delinquent taxes due to the County as well as appraisal and closing costs; and

WHEREAS, the Real Property Advisory Board has reviewed the appraisal and offer submitted by the Briscoe Lake Community Association and recommends that the County accept such offer, as the proposed sale would enable the Association to acquire ownership of the parcels for the purpose of maintaining the roads and lake areas for the benefit of the surrounding neighborhood; and

WHEREAS, the Real Property Advisory Board further recognizes that the parcels have limited independent utility and may not be readily understood by a purchaser at public auction to have limited or specialized value, particularly in light of their physical characteristics, location, and relationship to the surrounding properties; and

WHEREAS, the sale of the parcels at public auction could also result in their acquisition by a third party whose interests may not be consistent with the interests of the surrounding property owners, including the potential for such purchaser to seek to restrict, condition, or otherwise control access to or use of the parcels; and

WHEREAS, County Law permits the private sale of parcels acquired by Chapter 164 of the County Code, so long as a licensed New York State appraiser establishes the full value of the property as of the date of the transfer of title; and

WHEREAS, in addition to the purchase price, the Briscoe Lake Community Association will also be responsible for all future taxes as well as any other applicable charges, including but not limited to, omitted and pro-rated taxes, water and sewer charges, if any.

NOW, THEREFORE, BE IT RESOLVED, the Chairman of the Sullivan County Legislature is hereby authorized to execute the necessary documents in order to convey the aforesaid premises to the Briscoe Lake Community Association for the amount of Thirteen Hundred ($1,300.00) together with recording fees and any other applicable charges, including but not limited to omitted and pro rata taxes, water and sewer charges, if any.
