Specify Compliance with Procurement Procedures:

WHEREAS, property located in the Town of Callicoon/Village of Jeffersonville designated on the Sullivan County Real Property Tax Map as Callicoon 102.-1-10, being +/-50 x 150 feet, located at 45 Jefferson Ave., is owned by the County of Sullivan by virtue of an Article 11 foreclosure for 2024 taxes; and

WHEREAS, the parcel is improved by a dilapidated structure that is in substantial disrepair and presents an immediate danger to the health, safety and welfare of neighboring property owners and the surrounding community; and

WHEREAS, the parcel is a non-buildable lot under current zoning regulations, significantly limiting its potential use and development; and

WHEREAS, the Village of Jeffersonville has expressed its willingness to purchase the parcel for the purpose of addressing the dangerous condition of the property and removing the dilapidated structure; and

WHEREAS, the Village of Jeffersonville has offered to purchase the parcel for its fair market value, as determined in accordance with the County’s applicable Local Law, and has provided an appraisal establishing the fair market value of the parcel at Twenty-Three Thousand Dollars ($23,000.00); and

WHEREAS, as part of the proposed acquisition, the Village of Jeffersonville will assume responsibility for the demolition and removal of the dilapidated structure, thereby eliminating an immediate public safety hazard without requiring the County to incur the substantial costs associated with demolition; and

WHEREAS, the proposed sale will allow the County to recover all delinquent taxes and realize the fair market value of a non-buildable parcel for purposes of determining and distributing any surplus, while also facilitating the removal of a dangerous structure, eliminating a significant public safety hazard, and protecting the health, safety and welfare of neighboring property owners and the surrounding community; and

WHEREAS, the Real Property Advisory Board has reviewed the offer submitted by the Village of Jeffersonville and recommends that the County accept such offer, finding that the proposed sale will facilitate the cleanup and remediation of a dangerous site and serve the health, safety and welfare of the surrounding community; and

WHEREAS, in addition to the purchase price, the Village of Jeffersonville will also be responsible for all future taxes as well as any other applicable charges, including but not limited to, omitted and pro-rated taxes, water and sewer charges, if any.

NOW, THEREFORE, BE IT RESOLVED, the Chairman of the Sullivan County Legislature is hereby authorized to execute the necessary documents in order to convey the aforesaid premises to the Village of Jeffersonville for the amount of Twenty-Three Thousand Dollars ($23,000.00) together with recording fees and any other applicable charges, including but not limited to omitted and pro rata taxes, water and sewer charges, if any.
