INTRODUCED BY THE PUBLIC WORKS COMMITTEE TO AUTHORIZE THE EXECUTION OF AN AGREEMENT BETWEEN THE MUNICIPALITIES OF SULLIVAN COUNTY AND ORANGE COUNTY FOR THE REHABILITATION OF JOINTLY OWNED BRIDGE BIN 3345070.
WHEREAS, the Shawangunk Kill serves as the boundary between Orange County and Sullivan County at the location where such waterway is spanned by Bridge BIN 3345070, resulting in the bridge being in both Orange County and Sullivan County; and
WHEREAS, pursuant to Highway Law §237 Orange County and Sullivan County are liable for the costs, fees and expenses associated with the construction, care, maintenance, preservation and repair of Bridge BIN 3345070; and
WHEREAS, the New York State Department of Transportation (“NYSDOT”) regularly inspects bridges in the New York State, and any bridge given an overall condition rating less than 5.0 is considered deficient; and
WHEREAS, the NYSDOT inspected Bridge BIN 3345070 on September 9, 2022, and gave the bridge an overall condition rating of 4.627, and the bridge was red flagged by NYSDOT at that time; and
WHEREAS, based on the above, it was determined that rehabilitation work was to be performed to Bridge BIN 3345070; and
WHEREAS, an application was submitted to the NYSDOT by Orange County seeking grant funding through the BRIDGE NY program for costs associated with the necessary rehabilitation of Bridge BIN 3345070; and
WHEREAS, Orange County was notified by the NYSDOT that grant money was available for the rehabilitation of Bridge BIN 3345070, and Orange County was identified as the municipal sponsor of the project; and
WHEREAS, the estimated total cost of the rehabilitation of Bridge BIN 3345070 is $2,671,000, and Orange County has been informed that it shall be reimbursed through the BRIDGE NY program for ninety-five percent (95%) of the costs associated with the necessary rehabilitation of Bridge BIN 3345070, up to a total maximum reimbursement of $2,537,000; and
WHEREAS, it is anticipated that the NYSDOT and Orange County shall execute an agreement authorizing such reimbursement of costs associated with the rehabilitation of Bridge BIN 3345070; and
WHEREAS, Orange County and Sullivan County have determined that participating financially in the rehabilitation of Bridge BIN 3345070 is in their best interests; and
WHEREAS, pursuant to Article 5-G of the New York State General Municipal Law, Orange County and Sullivan County have the authority to enter into inter-municipal agreements.
NOW, THEREFORE, BE IT RESOLVED, that the County Manager is authorized to execute an Intermunicipal Agreement with Orange County in an amount not to exceed $67,000 for the Sullivan County share of the rehabilitation of border bridge BIN 3345070 and said agreement shall be in a form approved by the County Attorney.
