This resolution authorizes the award of RFP #R-26-16 and execution of an agreement with Accessibility Innovations Inc. to perform a comprehensive assessment of Sullivan County's current digital accessibility posture and develop a prioritized ADA Title II compliance action plan. The assessment and roadmap will assist the County in planning and budgeting for compliance with the U.S. Department of Justice's ADA Title II Web and Mobile Application Accessibility Rule, which requires compliance by April 24, 2027. This action authorizes only the assessment and planning phase and does not include remediation or implementation services.

RESOLUTION INTRODUCED BY THE EXECUTIVE COMMITTEE TO ENTER INTO A CONSULTING SERVICES AGREEMENT WITH ACCESSIBILITY INNOVATIONS INC.
WHEREAS, on April 24, 2024, the United States Department of Justice published a Final Rule amending 28 CFR Part 35, implementing Title II of the Americans with Disabilities Act (ADA) by establishing accessibility requirements for the web content and mobile applications of state and local governments, requiring Sullivan County to achieve compliance no later than April 24, 2027; and
WHEREAS, Sullivan County maintains public-facing websites, mobile applications, electronic documents, and numerous third-party software applications that must be evaluated to determine the County's current accessibility posture and identify the actions necessary to achieve compliance with the federal accessibility requirements; and
WHEREAS, the County issued Request for Proposals (RFP) #R-26-16, "ADA Title II Web & Mobile Application Accessibility Rule Consulting Services," seeking professional consulting services to assist the County in evaluating its digital accessibility environment and developing a prioritized strategy for achieving compliance; and
WHEREAS, following review of the initial proposals, the County requested revised proposals limited to the preparation of (i) a comprehensive current-state accessibility assessment and (ii) a prioritized ADA Title II compliance action plan to guide the County's future compliance efforts; and
WHEREAS, the revised proposals were reviewed by County staff, and the proposal submitted by Accessibility Innovations Inc. was determined to be in the best interest of Sullivan County based upon the proposed scope of services, methodology, project deliverables, implementation schedule, and overall cost; and
WHEREAS, the Sullivan County Legislature finds that obtaining a comprehensive assessment of the County's digital accessibility posture and a prioritized compliance roadmap is necessary to support future planning, budgeting, procurement, governance, and remediation activities required to achieve compliance with federal accessibility requirements;
NOW, THEREFORE, BE IT RESOLVED, that the Sullivan County Legislature hereby awards Request for Proposals (RFP) #R-26-16, "ADA Title II Web & Mobile Application Accessibility Rule Consulting Services," to Accessibility Innovations Inc. for professional consulting services consisting of a current-state accessibility assessment and the preparation of a prioritized ADA Title II compliance action plan, in accordance with its revised proposal; and
BE IT FURTHER RESOLVED, that the County Manager is hereby authorized to enter into an agreement with Accessibility Innovations Inc. for the above-described professional consulting services in an amount not to exceed Fourteen Thousand Five Hundred Fifty-One Dollars ($14,551.00), subject to approval as to form by the County Attorney; and
BE IT FURTHER RESOLVED, that the Commissioner of the Division of Information Technology Services, or his designee, is authorized to administer the resulting agreement, review and accept project deliverables, and take such administrative actions as may be necessary to carry out the intent of this Resolution.
