RESOLUTION INTRODUCED BY EXECUTIVE COMMITTEE AUTHORIZING A RETENTION INCENTIVE PROGRAM FOR EMPLOYEES AT THE ADULT CARE CENTER (“ADULT CARE CENTER”)

WHEREAS, the County of Sullivan has commenced the process of closing the Sullivan County Adult Care Center (the “Adult Care Center”); and

WHEREAS, the orderly and successful closure of the Adult Care Center will require the continued employment and cooperation of employees throughout the closure process in order to ensure continuity of care, compliance with applicable regulatory requirements, appropriate transition of residents, completion of records and other administrative responsibilities, and the orderly winding down of operations; and

WHEREAS, as the closure progresses, staffing needs will change and the County may require certain employees to remain employed beyond the point at which other employees are no longer needed in order to complete the remaining work associated with the closure; and

WHEREAS, the County recognizes that retaining experienced employees throughout the closure process is in the best interests of the residents, employees, and County and will assist in ensuring that the closure is completed in a safe, orderly, and responsible manner; and

WHEREAS, the County desires to establish a temporary retention incentive for county employees who remain employed and continue to perform the duties necessary to complete the Adult Care Center closure process; and

WHEREAS, the County also desires to provide a limited continuation of health insurance coverage for eligible employees who remain employed through the staffing reduction phase of the closure process and whose employment ends because their services are no longer required as staffing needs decrease; and

NOW, THEREFORE, BE IT RESOLVED, that the Sullivan County Legislature hereby authorizes the establishment of an Adult Care Center Closure Retention Incentive Program for Full-Time and Regular Part-Time County employees only, under the following terms and conditions:

1.                     Non-Management and non-exempt Management Employees. Eligible non-management employees of the Adult Care Center who remain employed by the County and continue to perform duties necessary to the closure of the Adult Care Center shall receive a retention incentive equal to ten percent (10%) of their current annual base salary, prorated based on a three (3) month closure process, payable on a biweekly basis, beginning on a date established by the County Manager; and

2.                     Exempt Management Employees. Eligible management employees of the Adult Care Center who remain employed by the County and continue to perform duties necessary to the closure of the Adult Care Center shall receive a retention incentive equal to twenty percent (20%) of their current annual base salary, prorated based on a three (3) month closure process, payable on a biweekly basis, beginning on a date established by the County Manager and/or Commissioner of Human Resources.

3.                     Regular Part-Time Employees. Eligible management employees of the Adult Care Center who remain employed by the County and continue to perform duties necessary to the closure of the Adult Care Center shall receive a retention incentive equal to twenty percent (20%) of their current annual base salary, prorated based on a three (3) month closure process, payable on a biweekly basis, beginning on a date established by the County Manager and/or Commissioner of Human Resources.

4.                     Duration of Incentive. The applicable retention incentive shall continue to be paid on a biweekly basis until the earlier of:

o                     the employee’s separation from County employment; or

o                     the completion of the Adult Care Center closure process as determined by the County Manager and/or Commissioner of Human Resources.

5.                     Eligibility Requirements. To remain eligible for the retention incentive, an employee must remain actively employed by the County and continue to perform assigned duties related to the operation, transition, or closure of the Adult Care Center, as determined by the County Manager and/or Commissioner of Human Resources.

6.                     Voluntary Resignation. An employee who voluntarily resigns from County employment shall not be eligible to receive any further retention incentive payments following the effective date of such resignation.

7.                     Staffing Reduction Health Insurance Benefit. An employee who remains employed through the closure process and whose employment is subsequently ended because the employee’s services are no longer required as staffing needs decrease during the closure process shall be eligible for three (3) additional months of County-provided health insurance coverage following the employee’s separation, subject to the terms and conditions established by the County and applicable health insurance plan requirements.

8.                     Exclusion from Health Insurance Benefit. The additional three-month health insurance benefit shall not be available to an employee whose employment ends as a result of the employee’s voluntary resignation. The benefit shall also not apply where an employee is terminated for cause or otherwise becomes ineligible for County health insurance coverage under applicable law, plan provisions, collective bargaining agreements, or County policy.

9.                     Administration. The County Manager and Commissioner of Human Resources are hereby authorized to administer the Adult Care Center Closure Retention Incentive Program, including determining employee eligibility, establishing the commencement and conclusion of the incentive period, determining when staffing reductions result in an employee’s services no longer being required, and taking such administrative actions as are necessary to implement this resolution.

10.                     Collective Bargaining Agreements and Applicable Law. Implementation of this resolution shall be subject to applicable law, Civil Service requirements, collective bargaining agreements, and the terms and conditions of applicable County benefit plans.

11.                     Funding. Funding for the retention incentive and any authorized continuation of health insurance coverage shall be provided from funds appropriated for the operation and closure of the Adult Care Center, or such other funds as may be lawfully appropriated for this purpose.

BE IT FURTHER RESOLVED, that Sullivan County Legislature hereby authorizes the County Manager, Commissioner of Human Resources, and the Commissioner of Management and Budget to take all necessary and appropriate actions to implement the Adult Care Center Closure Retention Incentive Program consistent with this resolution.
