RESOLUTION INTRODUCED BY PUBLIC WORKS COMMITTEE TO AUTHORIZE THE COUNTY MANAGER TO EXECUTE A MODIFICATION AGREEMENT WITH PHELPS GUIDE RAIL, INC. FOR ADDITIONAL GUIDE RAIL INSTALLATION SERVICES FOR THE 2026 GUIDE RAIL REPLACEMENTS ON VARIOUS COUNTY ROADS (“PROJECT”).
WHEREAS, Resolution No. 139-26, adopted April 23rd, 2026, authorized an agreement with Phelps Guide Rail, Inc. (“Agreement”) to provide construction services; and
WHEREAS, a section of County Road No. 56 in the Towns of Fallsburg and Mamakating has been identified as requiring guide rail repairs to improve roadway safety; and
WHEREAS, due to the contractor's competitive bid pricing and the availability of additional CHIPS funding provided through the 2026-2027 State Budget, these additional construction services can be completed utilizing previously allocated funding; and
WHEREAS, the Division of Public Works has reviewed the need to complete these construction services and recommends the approval of a Modification Agreement to cover this work.
NOW, THEREFORE, BE IT RESOLVED, that the County Manager be and hereby is authorized to execute a Modification Agreement, with Phelps Guide Rail, Inc., for additional construction services, associated with the 2026 Guide Rail Replacement Project, in an amount not to exceed $550,000, said Modification Agreement to be in a form approved by the County Attorney.
