WHEREAS, the County has adopted a Plan for representation of persons who are financially unable to obtain counsel pursuant to County Law Section 722; and
WHEREAS, Sullivan County Conflict Legal Aid, Inc., a not-for-profit corporation, has provided, under an existing contract, such services and legal representation of indigents in the event there is a conflict of interest with the Sullivan Legal Aid Panel, Inc.; and
WHEREAS, the contract with Sullivan County Conflict Legal Aid, Inc. expires on December 31, 2023; and
WHEREAS, RFP #R-23-43 was issued on October 20, 2023 seeking a legal representation services in the event of a conflict of interest with Sullivan Legal Aid Panel, Inc., responses thereto were due on November 17, 2023; and
WHEREAS, the County has a State mandated responsibility to provide representation of indigents in the event there is a conflict of interest with the Sullivan Legal Aid Panel, Inc.; and
WHEREAS, the Sullivan County Legal Aid, Inc., submitted a proposal on November 13, 2023; is the most responsible bidder; the County Manager negotiated the rate with Sullivan County Conflict Legal Aid, Inc., and the Administrator of Assigned Counsel recommends that the County enter into this agreement for the Term of January 1, 2024 through December 31, 2028; and
NOW, THEREFORE BE IT RESOLVED, that the Sullivan County Legislature hereby authorizes the County Manager to execute a contract with Sullivan County Conflict Legal Aid, Inc. for four (4) years commencing January 1, 2024 through December 31, 2028, in an amount not to exceed Five Hundred Twenty-Five Thousand Dollars ($525,000.00) per year, said contract to be in such form as the County Attorney shall approve.
BE IT FURTHER RESOLVED, that the Sullivan County Conflict Legal Aid, Inc. deliver a document of financial guarantee to the County Attorney.
