RESOLUTION INTRODUCED BY THE EXECUTIVE COMMITTEE TO AUTHORIZE AN AGREEMENT WITH ITAMAR J. YEGER, ATTORNEY AT LAW, FOR APPELLATE LEGAL SERVICES FOR THE SULLIVAN COUNTY DISTRICT ATTORNEY
WHEREAS, the Sullivan County District Attorney's Office is responsible for the prosecution of criminal matters and handles criminal appellate cases for the County of Sullivan; and
WHEREAS, the Sullivan County District Attorney has determined that specialized appellate legal services are necessary to assist the Office with appellate matters and to ensure the effective prosecution and defense of the County's interests in appellate proceedings; and
WHEREAS, Itamar J. Yeger, Attorney at Law, is qualified and experienced to provide appellate legal services to the Sullivan County District Attorney's Office; and
WHEREAS, the Sullivan County District Attorney desires to enter into an agreement with Itamar J. Yeger, Attorney at Law, for the provision of appellate legal services; and
WHEREAS, the contract period shall be for an initial term of one (1) year, at an amount not to exceed $75,000.00 annually, with an option to extend the agreement for up to five (5) additional one-year terms, subject to mutual agreement and all applicable County procurement requirements; and
WHEREAS, the Sullivan County District Attorney has recommended that the County enter into said agreement for the provision of appellate legal services; and
NOW, THEREFORE, BE IT RESOLVED, that the Sullivan County Legislature hereby authorizes the County Manager to execute an agreement with Itamar J. Yeger, Attorney at Law, for the provision of appellate legal services for the Sullivan County District Attorney's Office, for an initial term of one (1) year, at an amount not to exceed $75,000.00 annually and may be extended for up to five (5) additional one-year terms, upon mutual agreement of the parties, subject to annual appropriation, continued need for services, satisfactory performance, at an amount not to exceed $75,000.00 per year;
