RESOLUTION INTRODUCED BY THE EXECUTIVE COMMITTEE TO AUTHORIZE SULLIVAN COUNTY TO SUBMIT AN APPLICATION AND TO ENTER INTO CONTRACT WITH NEW YORK EMPIRE STATE DEVELOPMENT (ESD) FOR THE COUNTY INFRASTRUCTURE GRANT PROGRAM (CIGP)
WHEREAS, the fiscal year 2026 New York State Budget contains $100 million for the County Infrastructure Grant Program (CIGP) for county-led infrastructure projects supporting the creation of housing; and
WHEREAS, New York Empire State Development (ESD) CIGP is accepting applications from county governments for small and moderate-scale priority infrastructure projects; and
WHEREAS, Sullivan County (County) has identified an infrastructure project that will directly support development of a minimum 70-unit workforce/affordable housing development on land currently owned by the County in the Town of Liberty; and
WHEREAS, the housing development is proposed by a private developer, the Kearney Realty and Development Group, and would include mixed income rental units targeted to be affordable to households with gross incomes at or below 80%, 60% and 50% Area Median Income (AMI); and
WHEREAS, the County will partner with the Town of Liberty in collaboration with Delaware Engineering and the Kearney Realty and Development Group to implement a project that will include engineering and construction of new sewer connection lines and sewer main, a new pump station, an emergency generator, and an additional collection line (“Project”); and
WHEREAS, the estimated cost of the proposed scope of work will not exceed $3,100,000; and
WHEREAS, the Division of Planning, Community Development and Environmental Management proposes the County of Sullivan submit a NYS ESD CIGP application requesting $1,000,000, the maximum grant award, for the proposed infrastructure project scheduled to begin within twelve months of receipt of award and for a period of performance yet to be determined; and
WHEREAS, the remaining project costs will be met through County, Town and / or Developer collaborative contributions in the form of cash or in-kind match, and will account for a 50% matching funds requirement of CIGP; and
WHEREAS, there will be no additional out of pocket cost to the County, and
WHEREAS, ESD requires a $250 application fee upon submission of an application for funding, as well as an additional 1% fee upon execution of a Grant Disbursement Agreement (GDA) in the event an application is successful, and this cost will be covered by the developer; and
WHEREAS, the CIGP is a reimbursement grant.
NOW, THEREFORE, BE IT RESOLVED, that the Sullivan County Legislature hereby authorizes the County Manager, Chairman of the County Legislature, and / or their authorized representative to execute any and all necessary documents to enter into an Intermunicipal Agreement with the Town of Liberty; and
BE IT FURTHER RESOLVED, that the Sullivan County Legislature hereby authorizes the County Manager, Chairman of the County Legislature, and / or their authorized representative (as required by the funding source) to execute any and all necessary documents to submit the FY 26 New York Empire State Development CIGP application for funding; and
BE IT FURTHER RESOLVED, that the Sullivan County Legislature hereby authorizes the County Manager, and / or Chairman of the County Legislature (as required by the funding source) to accept the award, and enter into an award agreement or contract to administer the funding secured, in such form as the County Attorney shall approve; and
BE IT FURTHER RESOLVED, that the Sullivan County Legislature hereby authorizes payment of the $250 application fee as well as an additional 1% fee upon execution of a GDA in the event that the application for funding is successful, with the 1% fee not to exceed $10,000; and
BE IT FURTHER RESOLVED, that should the FY 26 NYS ESD CIGP funding be terminated, the County shall not be obligated to continue any action undertaken by the use of this funding.
