RESOLUTION INTRODUCED BY PUBLIC WORKS COMMITTEE TO ENGAGE AN INVESTIGATOR TO INVESTIGATE VIOLATIONS OF THE COUNTY’S FLOW CONTROL ORDINANCE

 

WHEREAS, Section 171-6(B) of the County Code, commonly referred to as the “Flow Control Ordinance,” prohibits the pick up or hauling of solid waste and/or recyclables generated inside the County to a solid waste management facility located outside of the County;

 

WHEREAS, violations of the Flow Control Ordinance are punishable by civil, criminal and administrative penalties;

 

WHEREAS, the County Legislature has determined that enforcement of the Flow Control Ordinance is necessary to protect public health and safety;

 

WHEREAS, the County Legislature has determined that enforcement of the Flow Control Ordinance requires evidence gathering to support a determination that a violation has occurred and that penalties should be imposed;

 

WHEREAS, the County Legislature has determined that the engagement of an investigator is reasonable and necessary to support enforcement of the Flow Control Ordinance; and

 

WHEREAS, the County Legislature has determined that such investigator will be compensated by the County on an hourly basis at the rate of $44.90 per hour and not to exceed $10,000.

 

NOW THEREFORE BE IT RESOLVED, that the County Legislature authorizes the County Manager, in consultation with the Commissioner of the Division of Public Works, to engage the services of an investigator to investigate violations of the Flow Control Ordinance at a cost not to exceed $10,000.
