BOE Update
v Independent Petitions were filed at the Board of Elections May 20th-May 27th, during which time our office received 18 petitions nominating 25 candidates. As of May 29th, the BOE is in receipt of one (1) objection.

Status of the “Even Year Law”
v Last month, the Appellate Division, Fourth Department ruled:
“It is hereby ORDERED that the order and judgment so appealed from is unanimously reversed on the law without costs, the motions are granted, the decretal paragraphs are vacated, and judgment is granted in favor of defendants State of New York, Kathleen Hochul, in her capacity of Governor of State of New York, and Dustin M. Czarny, in his capacity as Commissioner of Onondaga County Board of Elections as follows:
It is ADJUDGED and DECLARED that chapter 741 of the Laws of 2023 does not violate the New York Constitution or the United States Constitution.”
v The case is expected to be heard in the NYS Court of Appeals in September
v The law currently impacts State and Local elections as follows:
The new law primarily impacts town offices (including Town Supervisor, Town Board Member, Town Clerk, and Highway Superintendent), as well as certain county offices (including County Executive, County Comptroller, and County Legislator). However, it does NOT affect any of the aforementioned offices should they have a three-year term.
All currently serving elected officials will fulfill the entirety of their term. Should an office be impacted by this legislation, it will fall into one of three categories:
• An office with a two-year term, to be elected in 2025, will be elected for a one-year term ending in 2026;
• An office with a four-year term, to be elected in 2025, will be elected for a three-year term ending in 2028; or
• An office with a four-year term, to be elected in 2027, will be elected for a three-year term ending in 2030.
It should be noted that this new law does not impact city or village offices, nor does it impact school or fire district elections. It also does not impact the specific offices of County Sheriff, County Clerk, District Attorney, County Court Judge, Family Court Judge, Surrogate’s Court Judge, or Town Justice.
Important Dates, Deadlines & Information:
v June 14th is the last day for the Board of Elections to receive a Voter Registration by mail or in person (our office will be open from 9am until 5pm) for the Primary Election. This is also the last day for the BOE to receive an Absentee/Early Vote by Mail application by mail or portal.
Ø Any Voter may request a postage paid Early Vote by Mail Ballot (no reason required), by paper application or via the online portal: <https://elections.ny.gov/request-ballot>.
v June 9th is the last day for the BOE to receive a change of address from a Voter.
v Early Voting for the June Primary runs from Saturday, June 14th until Sunday, June 22nd at the Sullivan County Government Center in Monticello and Public Health in Liberty. The hours are posted on our website at: <https://sullivanny.us/Departments/Elections/EarlyVoting>
As always, there is no Early Voting the day before the election (Monday, June 23rd).
v Primary Election is Tuesday, June 24th. All Poll Sites will be open from 6am until 9pm in Sullivan County.
v Our Summer Office hours will be 8:00AM until 4:00PM, Monday through Friday, beginning Monday, June 30th until Friday, September 5th (excluding mandatory filing dates).
