RESOLUTION INTRODUCED BY THE EXECUTIVE COMMITTEE TO AUTHORIZE THE ABOLISHMENT OF IDENTIFIED POSITIONS, AND TO DELEGATE IMPLEMENTATION AUTHORITY TO THE COUNTY MANAGER.
WHEREAS, the County of Sullivan operates the Care Center at Sunset Lake (“ACC”), a skilled nursing facility; and
WHEREAS, the Sullivan County Legislature has commenced the closure of the ACC; and
WHEREAS, the planned closure is likely to occur over an approximately three (3) month period, during which the resident census will be progressively reduced as residents are placed in suitable alternative facilities in accordance with applicable law and regulations, including requirements of the New York State Department of Health; and
WHEREAS, pursuant to New York County Law § 204, the Legislature possesses the authority to establish and abolish positions of county employment; and
WHEREAS, the Legislature has identified the specific positions to be abolished, as set forth herein, and has determined that the timing and sequencing of the abolishment of such positions shall be administered by the County Manager in accordance with the parameters established by this Resolution, Civil Service Law §§ 80-85, and applicable collective bargaining agreements.
NOW THEREFORE BE IT RESOLVED, the Sullivan County Legislature, having commenced with the closure of the ACC, hereby directs the County Manager to coordinate all operational, regulatory, and resident-placement activities necessary to effectuate the closure in a safe and orderly manner; and
BE IT FURTHER RESOLVED, that the county positions listed in Attachment A, currently assigned to ACC, are hereby abolished effective upon the dates determined by the County Manager; and
BE IT FURTHER RESOLVED, the County Manager is hereby authorized and directed, in consultation with the ACC Administrator and the Commissioner of Human Resources, to implement the abolishment of the positions identified above on a phased basis tied to the progressive reduction of the resident census during the closure period, provided that: (a) all layoffs shall be completed no later than the time frame in which the State DOH approves the county having successfully closed the facility; (b) the sequencing of individual layoffs shall comply with Civil Service Law §§ 80-85; and (c) the County Manager shall not abolish any position not identified in this Resolution without further legislative action.
