RESOLUTION INTRODUCED BY THE PLANNING, , REAL PROPERTY AND ECONOMIC DEVELOPMENT COMMITTEE TO AUTHORIZE CHANGE ORDERS FOR A CONTRACT WITH Wheat and Sons General Contracting, Inc., ON CONSTRUCTION OF IMPROVEMENTS TO THE NYS DEC FISHING ACCESS LOCATED IN THE TOWN OF HIGHLAND, NY                     

 

WHEREAS, Sullivan County (“County”) entered into a contract with Wheat and Sons in accordance with Bid #B-22-54, authorized by Resolution 406-22, to construct improvements at the NYS DEC Fishing Access located in the Town of Highland; and

WHEREAS, during the course of construction unforeseen conditions required additional services and materials to be rendered and provided, causing the need for Change Orders 1 through 6; and

WHEREAS, Change Orders #4, #5, and #6 fall within the scope of the original contract and resulted in a credit to the County in the amount of $29,950; and

WHEREAS, Change Order #1 falls within the scope of the original contract (tree removal) and resulted in an additional cost to the County in the amount of $500; and

WHEREAS, Change Orders #2 and #3 fall outside the scope of the original contract but were necessary in order for the project to continue on schedule and to ensure safe site conditions; and

WHEREAS, Change Order #2 was required due to the discovering the extent of the historic canal wall was considerably more than found in 2018. The plans called for mechanical removal of invasive species and power washing around 80 linear feet of exposed stone. Upon review, around 200 linear feet of additional wall was required to be exposed and cleaned at and additional cost of $6,625; and

WHEREAS, Change Order #3 was required due to unstable soil conditions and an intermittent underground spring, stabilization of the subgrade soils below a segment of the proposed paved trail was required. Additional excavation was necessary and 43 tons of “surge stone” product was installed, with geotextile, to stabilize the subbase. The boat launch was reconfigured to avoid impacts to the canal wall and the slope of the pad adjusted to reflect the average high and low river water mark elevations, and additional boulders and stone fill were added to stabilize the cut slope. This modified scope of services resulted in an additional cost of $33,950; and

WHEREAS, the net cost increase of Change Orders #1-6 is $11,125; and

WHEREAS, the net cost increase does not exceed the total project funding authorized by Resolution 402-66.

NOW, THEREFORE BE IT RESOLVED, the Sullivan County Legislature hereby authorizes the County Manager to execute the necessary documents to modify the scope of the original contract with Wheat and Sons to reflect Change Orders #2 and #3; and

BE IT FURTHER RESOLVED, that the total project cost authorized by Resolution 406-22 shall remain unchanged.
