RESOLUTION INTRODUCED BY THE MANAGEMENT AND BUDGET COMMITTEE TO AUTHORIZE THE COUNTY MANAGER TO EXECUTE MODIFICATION AGREEMENTS WITH THE NEW YORK STATE OFFICE OF INDIGENT LEGAL SERVICES; SULLIVAN LEGAL AID PANEL, INC.; AND SULLIVAN COUNTY CONFLICT LEGAL AID, INC. TO AUTHORIZE PAYMENTS IN ACCORDANCE WITH THE FOURTH UPSTATE QUALITY IMPROVEMENT AND CASELOAD REDUCTION GRANT
WHEREAS, pursuant to Resolution No. 322-23, adopted by the Sullivan County Legislature on August 17, 2024, the County entered into a contract with the New York State Office of Indigent Legal Services (“NYSOILS”) and Modification Agreements with the Sullivan Legal Aid Panel, Inc. and Sullivan County Conflict Legal Aid, Inc. for funding through the Fourth Upstate Quality Improvement and Caseload Reduction Grant to improve the quality of indigent legal services provided by the County pursuant to Article 18-B of the County Law; and
WHEREAS, the Contract (“Contract No. C4th648”) commenced on July 1, 2023 and expires on June 30, 2026; and
WHEREAS, NYSOILS has proposed a contract amendment to extend Contract No. C4th648 an additional 6 months through December 31, 2026 with additional funding of $50,000.00 for a total Contract amount of $350,000, under the same terms and conditions; and
WHEREAS, in order to provide the additional funding under Amended Contract No. C4th648 to the Sullivan Legal Aid Panel, Inc. and the Sullivan County Conflict Legal Aid, Inc, for the extended time period, it is necessary to modify their respective contracts.
NOW, THEREFORE BE IT RESOLVED, that the County Manager is hereby authorized to execute a contract amendment with NYSOILS to extend the existing agreement with an additional $50,000 in funding, for a total of $350,000 for the period from July 1, 2023 through December 31, 2026, said agreement to be in a form approved by the County Attorney; and
BE IT FUTHER RESOLVED, that the County Manager is hereby authorized to execute Modification Agreements with the Sullivan Legal Aid Panel, Inc. for an additional amount not to exceed $31,000.00 for the extended 6-month period from July 1, 2026 through December 31, 2026, and Sullivan County Conflict Legal Aid, Inc. for a- additional amount not to exceed $19,000 for the extended 6-month period from July 1, 2026 through December 31, 2026; and
BE IT FURTHERED RESOLVED, that the form of any such agreements be approved by the County Attorney; and
BE IT FURTHER RESOLVED, that should the NYSOILS funding be terminated, the County shall not be obligated to continue any action undertaken by the use of this funding.
