RESOLUTION INTRODUCED BY PUBLIC SAFETY AND LAW ENFORCEMENT COMMITTEE TO AUTHORIZE A STIPEND FOR DISTRICT ATTORNEY OFFICE EMPLOYEES TO SUPPORT NEW YORK STATE DIVISION OF CRIMINAL JUSTICE SERVICES DISCOVERY REFORM AND AID TO PROSECUTION PROGRAMS
WHEREAS the Sullivan County District Attorney requests that Position No. 3748 and Position No. 3699 each receive a stipend of $10,000, and
WHEREAS, the New York State Division of Criminal Justice Services ("DCJS") provides funding through the Discovery Reform Program to assist counties in meeting the requirements of New York State Criminal Procedure Law governing discovery compliance and disclosure obligations; and
WHEREAS, the New York State Division of Criminal Justice Services also provides Aid to Prosecution funding to enhance the investigation and prosecution of repeat, violent, and serious felony offenders; and
WHEREAS, Sullivan County has received funding under the DCJS Discovery Reform Program, appropriation account R3089-R167, and the DCJS Aid to Prosecution Program, appropriation account R3089-R247; and
WHEREAS, Position No. 3748 performs ongoing responsibilities in support of the DCJS Discovery Reform Program, including coordinating discovery compliance; assisting with the identification, collection, organization, management, and disclosure of discoverable materials; facilitating Brady compliance; supporting countywide criminal justice technology initiatives and records management systems; coordinating with law enforcement agencies regarding discovery obligations; and performing related administrative and operational functions necessary to ensure compliance with New York State discovery laws; and
WHEREAS, Position No. 3699 performs ongoing responsibilities in support of the DCJS Aid to Prosecution Program, including coordinating the operational and logistical requirements associated with active criminal prosecutions; arranging and managing travel, lodging, meals, and related accommodations for victims, witnesses, investigators, expert witnesses, interpreters, and other authorized participants; coordinating witness appearances, investigative resources, and; facilitating District Attorney litigation support services; and performing other duties that directly support the preparation, investigation, and successful prosecution of criminal matters consistent with the objectives of the DCJS Aid to Prosecution Program; and
WHEREAS, the County Legislature finds that Position Nos. 3748 and 3699 performance of specialized responsibilities that directly advance the purposes of the respective DCJS grant programs and are essential to maintaining compliance with New York State discovery requirements while supporting the effective investigation and prosecution of criminal matters; and
WHEREAS, the County Legislature further finds that the payment of these grant-funded stipends is an appropriate expenditure of the respective DCJS grant funds to ensure the continued fulfillment of the grant objectives for which the funds were awarded; and
WHEREAS, sufficient and allowable funding is available within the respective DCJS grant appropriations to support these stipends without additional costs to the County;
WHEREAS, it is necessary to designate and compensate a qualified employee within the District Attorney’s Office to assume these additional responsibilities in support prosecutorial efforts and discovery compliance
NOW, THEREFORE, BE IT RESOLVED, that the Sullivan County Legislature hereby authorizes a grant-funded stipend in the amount of ten thousand dollars ($10,000.00) for Position No. 3748, to be funded from the New York State Division of Criminal Justice Services Discovery Reform Program, appropriation account R3089-R239, payable during the period in which grant funding remains available and appropriated for such purpose; and
BE IT FURTHER RESOLVED, that the Sullivan County Legislature hereby authorizes a grant-funded stipend in the amount of ten thousand dollars ($10,000.00) for Position No. 3699, to be funded solely from the New York State Division of Criminal Justice Services Aid to Prosecution Program, appropriation account R3089-R247, payable during the period in which grant funding remains available and appropriated for such purpose; and
BE IT FURTHER RESOLVED, that the County Manager and/or the Chair of the Sullivan County Legislature, as required by the applicable funding source, are hereby authorized to execute any and all documents necessary to effectuate the purposes of this Resolution; and
NOW, THEREFORE BE IT RESOLVED, that each stipend authorized herein shall remain subject to the continued availability of the respective grant funding source, and Sullivan County shall have no obligation to continue either stipend in the event the applicable New York State DCJS funding is reduced, suspended, or terminated.
