INTRODUCED BY THE PUBLIC WORKS COMMITTEE TO AUTHORIZE GRANTING OF A PERPETUAL EASEMENT FOR A DRIVEWAY IN THE TOWN OF MAMAKATING OFF OF THORTON ROAD.

 

WHEREAS, the County of Sullivan owns a parcel of land located in the Town of Mamakating and depicted on the Tax Map as section 4 block 3-1 lot 34; and

WHEREAS, the owner of the adjoining parcel depicted on the Tax Map as Section 4 Block 1 lot 21 currently has a driveway for access to the parcel which crosses the County owned parcel; and

WHEREAS, the driveway on the adjacent parcel has been in this location for over 100 years per a review of local records and

WHEREAS, the owner of the adjacent parcel has requested that a perpetual easement be granted by the County so that they maintain access to this parcel; and

WHEREAS, the County takes no exception to granting such easement; and

WHEREAS, the owner of the adjacent parcel has retained the services of TS Land Surveying, P.C, 518 Broadway, Suite 12, Monticello, New York to prepare a description of the requested 15 wide perpetual easement which is shown on a boundary survey dated 03/31/2025 along with a metes and bounds description; and

NOW, THEREFORE, BE IT RESOLVED, that the County of Sullivan hereby grants a perpetual easement as described above to the owner of Town of Mamakating Parcel SBL 4.-1-21 to allow for continued access to the parcel.

NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Chairman of the Legislature is authorized to sign any necessary documents, in a form as approved by the County Attorney to effectuate the granting of this easement.
