RESOLUTION INTRODUCED BY THE EXECUTIVE COMMITTEE TO PRESERVE RETENTION PAYMENTS AND BENEFITS FOR QUALIFIED ADULT CARE CENTER EMPLOYEES WHO VOLUNTARILY RESIGN TO ACCEPT OTHER EMPLOYMENT EFFECTIVE ON OR AFTER OCTOBER 15, 2026

WHEREAS, the Sullivan County Manager’s Office announced the closure of the Adult Care Center (“ACC”) on August 19, 2026; and

WHEREAS, on August 20, 2026, the Sullivan County Legislature (“Legislature”) adopted Resolutions No. 302-26, 303-26, and 304-26, authorizing ACC employee layoffs, longevity payments, and retention incentives for qualified ACC employees who remained actively employed during the closure process; and

WHEREAS, on October 1, 2026 the Legislature authorized the closure of the Adult Care Center and authorized the County Manager to issue a Request for Proposal to identify an alternative operator to provide nursing home services in Sullivan County; and

WHEREAS, eligible employees qualified to receive retention payments equal to 10% or 20% of their current annual base salary, depending on their positions at the facility, in recognition of their continued service and efforts to maintain the standard of care for ACC residents during the closure process; and

WHEREAS, the above resolutions establish eligibility requirements for such payments and address the effect of voluntary resignation on eligibility; and

WHEREAS, approximately twenty-three (23) ACC employees were notified on September 11, 2026, that their layoffs would be effective September 25, 2026; and

WHEREAS, on September 16, 2026, the Honorable Kevin R. Bryant, J.S.C., issued an order temporarily restraining the County from proceeding with the ACC closure plan; and

WHEREAS, the resulting uncertainty regarding the timing and continuation of the closure process has created challenges for ACC employees seeking to make employment decisions and secure continued employment; and

WHEREAS, certain ACC employees may have opportunities to accept other positions within Sullivan County government or with other employers, and the Legislature recognizes the importance of allowing these employees to pursue such opportunities without unnecessarily forfeiting retention payments or other benefits for which they would otherwise qualify under the applicable resolutions; and

WHEREAS, the Legislature wishes to permit qualified ACC employees to voluntarily resign from their positions to accept other employment, whether within another Sullivan County department or division or with an outside employer, or anyone seeking retirement, without such resignation alone disqualifying them from receiving applicable retention payments, longevity payments, or other benefits authorized under Resolutions No. 302-26 and 304-26.

NOW, THEREFORE, BE IT RESOLVED,   effective on or after October 15, 2026, that any ACC employee who voluntarily resigns from their ACC position to accept another position within Sullivan County government or employment with another organization on a separation date approved by the County Manager, shall be treated as having remained employed for purposes of those resolutions and shall receive the retention incentive in the amount that would have been payable through the three-month closure period described in Resolution No. 302-26, the longevity payment as provided in Resolution No. 304-26, and the health insurance coverage provided in Resolution No. 302-26 § 7, subject to all other applicable eligibility requirements established by the Legislature.
