RESOLUTION INTRODUCED BY NADIA RAJSZ, CHAIR OF THE SULLIVAN COUNTY LEGISLATURE, AUTHORIZING THE CLOSURE OF THE ADULT CARE CENTER AND AUTHORIZING THE COUNTY MANAGER TO ISSUE A REQUEST FOR PROPOSAL TO IDENTIFY AN ALTERNATIVE OPERATOR TO PROVIDE NURSING HOME SERVICES IN SULLIVAN COUNTY
WHEREAS, Sullivan County owns and operates the Adult Care Center, also known as the Care Center at Sunset Lake (the “ACC”), located at 256 Sunset Lake Road, Liberty, New York, an Article 28 residential health care facility; and
WHEREAS, due to significant and sustained financial pressures facing Sullivan County, including the escalating cost of operating the ACC, the Sullivan County Legislature has determined that the County can no longer continue to operate the ACC; and
WHEREAS, Sullivan County submitted a formal closure plan for the ACC to the New York State Department of Health (“NYS DOH”) in accordance with applicable State and federal requirements; and
WHEREAS, NYS DOH approved Sullivan County’s closure plan on August 13, 2026, and the Legislature acknowledging the need to vote on the closure plan subsequent to this approval; and
WHEREAS, the closure of the ACC requires the County to undertake and complete the necessary steps to safely and appropriately transition residents, address employee and labor matters, preserve and transfer records, satisfy regulatory requirements, and otherwise complete the closure in accordance with the approved closure plan and the directives of NYS DOH; and
WHEREAS, notwithstanding the closure of the ACC, the County Legislature recognizes the continued need for nursing home and long-term residential health care services within Sullivan County, and it is the intention of the County to seek and support an alternative operator possessing, or capable of obtaining, its own Certificate of Need to provide such services within the County; and
WHEREAS, the County Legislature finds that authorizing the County Manager to issue a Request for Proposal seeking such an operator will facilitate the continued availability of nursing home services to Sullivan County residents following the closure of the ACC.
NOW, THEREFORE, BE IT RESOLVED, that the Sullivan County Legislature hereby authorizes and directs the closure of the Adult Care Center, also known as the Care Center at Sunset Lake, pursuant to the closure plan submitted to and approved by NYS DOH on August 13, 2026; and
BE IT FURTHER RESOLVED, that the County Manager is hereby authorized and directed to take all actions reasonably necessary to implement and complete the closure of the ACC in accordance with the NYS DOH-approved closure plan, including coordinating with NYS DOH and other applicable governmental agencies and ensuring compliance with all applicable regulatory requirements; and
BE IT FURTHER RESOLVED, that the County Manager is hereby authorized and directed to prepare and issue a Request for Proposal (“RFP”) seeking a qualified operator, possessing or capable of obtaining its own Certificate of Need, to establish and operate a nursing home or other long-term residential health care facility to serve the residents of Sullivan County, including establishing appropriate terms, conditions, submission requirements, and evaluation criteria; and
BE IT FURTHER RESOLVED, that any proposed sale, lease, or other disposition of the real property to a selected operator shall be presented to the Sullivan County Legislature for such further review, authorization, approval, and execution as may be required by law.
