RESOLUTION INTRODUCED BY EXECUTIVE COMMITTEE TO CONVEY PROPERTY ACQUIRED BY THE COUNTY OF SULLIVAN BY VIRTUE OF THE IN REM TAX FORECLOSURE PROCEEDING FOR THE 2024 LIEN YEAR IN THE TOWN OF THOMPSON KNOWN AS TH52.G-1-96
WHEREAS, property located in the Town of Thompson designated on the Sullivan County Real Property Tax Map as Thompson 52.G-1-96, being .45 +/- acres, located on Cardiff Ln is owned by the County of Sullivan by virtue of an Article 11 foreclosure for 2024 taxes; and
WHEREAS, Town of Thompson has requested that the County transfer title of said property to the Town of Thompson so that they can maintain the road and cul de sac located on said property, (see attached map) due to the fact that the same services 15 different owners in an undeveloped cul de sac in the Emerald Green Subdivision; and
WHEREAS, the Real Property Advisory Board has reviewed the parcel and recommends that the County transfer said parcel to the Town of Thompson for the purpose of maintaining the road for the benefit of the surrounding homeowners if as and when the same is developed; and
WHEREAS, the Real Property Advisory Board further recognizes that the parcel has limited independent utility and may not be readily understood by a purchaser at public auction to have limited or specialized value, particularly in light of its physical characteristics, location, and relationship to the surrounding properties; and
WHEREAS, the sale of the parcel at public auction could also result in the acquisition by a third party whose interests may not be consistent with the interests of the surrounding property owners, including the potential for such purchaser to seek to restrict, condition, or otherwise control access to or use of the parcel; and
WHEREAS, the total taxes due to the County are less than $75.00 and the County Treasurer will obtain an order of the County Court confirming that there will be no surplus available for the parcel in question due to the circumstances set forth above; and
WHEREAS, the Town of Thompson will be responsible for the recording fees and any other applicable charges, including but not limited to, omitted and pro rata taxes and water and sewer charges, if any, and
NOW, THEREFORE, BE IT RESOLVED, the Chairman of the Sullivan County Legislature is hereby authorized to execute the necessary documents in order to convey the aforesaid premises to Town of Thompson upon receipt of the County Clerk fees and any other applicable charges, including but not limited to omitted and pro rata taxes, water and sewer charges, if any.
