RESOLUTION TO AUTHORIZE THE COUNTY MANAGER TO EXECUTE A CONTRACT WITH OPTIMA ENVIRONMENTAL SERVICES, INC., FOR THE CLOSURE AND REMOVAL OF ABOVEGROUND PETROLEUM BULK STORAGE TANKS (REPLACE RESOLUTION 10-26)

 

WHEREAS, the County of Sullivan owns and maintains many aboveground petroleum bulk storage tanks; and

 

WHEREAS, several tanks have recently been replaced or deemed not required and taken out of service; and

 

WHEREAS, the New York State Department of Environmental Conservation has requirements for the proper closure and disposal of out of service tanks; and

 

WHEREAS, the Sullivan County Purchasing Department and Division of Public Works issued a bid (B-25-55) to have the out of service aboveground tanks properly closed and removed, including cutting and cleaning; and

 

WHEREAS, in January 2026 Resolution 10-26 awarded contract to the low bidder, which never executed the contract documents and has now withdrawn its bid, due to no fault of the County. 

 

WHEREAS, the New York State Department of Environmental Conservation has a timeframe for completion of this work, which is running out, so the next low bidder from the original bid (B-25-55) has been contacted and has agreed to hold their original price for the scope of work; and

 

WHEREAS, the apparent new responsible low bidder is Optima Environmental Services, Inc., and the Division of Public Works recommends award of contract for said work. 

 

NOW, THEREFORE, BE IT RESOLVED, that the County Manager be authorized to execute a contract with Optima Environmental Services, Inc., 92-94 Stewart Avenue, Newburgh, NY 12550, not to exceed $35,000.00 to be in such form as the County Attorney shall approve.
